Order Before: ENGEL and KEITH, Circuit Judges and PECK, Senior Circuit Judge. The defendant S and C Steamship Lines appeals a judgment of $140,000 entered in favor of the plaintiff following a jury trial. Plaintiff's complaint alleged that he slipped and fell down certain steps in the Engine Department of the S. S. Henry Steinbrenner while employed thereon as a seaman. The complaint further alleged negligence of the steamship line under the Jones Act, 46 U.S.C. § 688 (1976) and unseaworthiness of that vessel under the general admiralty and maritime law. Motions for judgment notwithstanding the verdict and for a new trial were timely made and denied. On appeal the steamship company argues that the verdict was the result of passion created by the prejudicial misconduct of plaintiff's counsel and that the damages awarded were in all events excessive. We agree.
