494 This is a discovery of assets proceeding. See Â§Â§ 473.340 to 473.353, inclusive. The probate court sustained a motion for judgment on the pleadings filed by plaintiff-executrix and accordingly entered a judgment for plaintiff. Upon appeal to the circuit court a judgment was also entered on the pleadings in favor of plaintiff and against defendants. Defendants appealed to the St. Louis District of the Court of Appeals. That court adopted the opinion of Judge Simeone which reversed the judgment and remanded the case with directions to enter a judgment in favor of defendants. Upon plaintiffs application we ordered the case transferred to this court. It will be 495 determined here "the same as on original appeal." Mo. Const., Art. V., Â§ 10, V.A.M.S.
